The Office of the Prosecutor General and the Zhytomyr Regional Prosecutor’s Office were unable to complete the investigation into the case against Kyiv Regional Council deputy Vitaliy Karlyuk (a member of the political party faction "European Solidarity"), who was accused of raiding the "Rusava-K" agricultural complex in Kaharlyk.

The complex belonged to soldier Mark Paslawsky (call sign "Franko"), who was killed in the ATO and served in the volunteer battalion "Donbas".

This is stated in criminal investigation No. 12016100010001219 against four individuals under Part 3 of Article 206-2 of the Criminal Code, which was closed under clause 10, part 1, article 284 of the CPC.

In 2019, the then Prosecutor General Yuriy Lutsenko announced the suspicion against Kyiv Regional Council deputy Vitaliy Karlyuk.

Karlyuk is accused of raiding the "Rusava-K" agricultural complex in Kaharlyk, which belonged to soldier Mark Paslawsky (call sign "Franko"), who was killed in the ATO and served in the volunteer battalion "Donbas".

Paslawsky, a Ukrainian-American, rose to the rank of major in the U.S. Army (retired in 1991), but served as a regular soldier in the battalion. In the 1990s, he moved to Ukraine and received Ukrainian citizenship shortly before his death.

He died on August 19, 2014, while covering the retreat of a group of soldiers from Illovaisk.

Following a series of re-registrations, ownership rights to the "Rusava-K" company transitioned to Volodymyr Bortnyk, who owned three percent of the company during Paslawsky’s lifetime, as well as to the aforementioned foreign "Druce Corporate Holdings Limited," led by the deceased soldier.

In February 2015, changes to the director and participants of LLC "Rusava-K," the agricultural complex in Kaharlyk owned by Paslawsky, were registered. The company was re-registered to Leonid Mosiychuk. The basis was an agreement dated 11.08.2014 on the purchase and sale of a share of corporate rights between DRUCE CORPORATE HOLDINGS LIMITED (BVI) represented by Paslawsky and Mosiychuk, verified by the parties’ signatures on 10.09.2014. However, at the time of signing, Paslawsky was already officially deceased. It was later revealed that an apartment in Lviv was suspiciously alienated based on a will that was not drawn up.

Mosiychuk has been wanted under Part 3 of Article 206-2 of the Criminal Code since 2016 in the case No. 12015110190000080. This is a similar case, but with only one suspect.

It was registered on February 9, 2015, regarding illegal appropriation of property and forgery of documents. In February 2016, a new case No. 12016100010001219 was registered under Part 3 of Article 206-2, Part 1 of Article 367, Part 1 of Article 388, Article 356, Part 1 of Article 358, Part 4 of Article 191, and Part 1 of Article 364 of the Criminal Code. It is currently closed.
