Stefanishyna did not post 6 million hryvnias in bail: her preventive measure may be changed

Stefanishyna did not pay the bail: she may be taken into custody.

As MEZHI learned, as of August 12, former Deputy Prime Minister for European Integration and former Ukrainian Ambassador to the United States Olha Stefanishyna has not paid the full bail amount of UAH 6 million.

Stefanishyna was supposed to pay the UAH 6 million bail by the end of August 11. The court must now change her preventive measure if the bail is still not paid by the date of the next hearing.

According to Part 6 of Article 182 of the Criminal Procedure Code of Ukraine, a person not in custody must pay bail within five days after the court’s decision. However, it can also be paid later if the court has not yet changed the preventive measure by that time.

At the same time, Part 1 of Article 200 of the CPC of Ukraine allows the prosecutor or investigator, with the prosecutor’s consent, to petition the court to change the preventive measure. This requires justification as to why the previous measure is insufficient and what risks remain.

 Therefore, due to the non-payment of bail, NABU and SAPO may petition the investigating judge to change the preventive measure to a stricter one.

Given that the court has already imposed bail as a preventive measure, the changed measure could be detention.

At the same time, until a decision is made to change the preventive measure, Stefanishyna may still pay the UAH 6 million bail.

 As a reminder, NABU and SAPO notified Stefanishyna of suspicion of illegal enrichment worth UAH 13.9 million that did not match her official income. In her declaration, she failed to indicate two one-room apartments, funds for their renovation, expenses for her mother’s treatment, air tickets, rent for another apartment, and the use of a Mercedes registered to a subordinate.

On July 6, the court imposed bail of UAH 6 million on Stefanishyna and set obligations that will apply for two months. She must appear when summoned by NABU, the prosecutor, and the court, and notify them of any change of residence or location. She is also prohibited from contacting Mazurenko, Kholodovych, Buriachenko, and Shatokhin, who are involved in the case.
