Kolomoiskyi’s case on embezzlement of UAH 9.2 billion in PrivatBank left in HACC: defence denied

The Appellate Chamber of the High Anti-Corruption Court has denied the defence’s motion to transfer the criminal proceedings against Ihor Kolomoiskyi and former top managers of PrivatBank to another court.

This was reported by the press service of the Appellate Chamber of the HACC.

On August 28, 2026, the panel of judges considered the defence’s motion to refer the case from the HACC to another court. Following the review, the court denied the motion.

The ruling took legal effect immediately after it was announced. It cannot be appealed in cassation.

The case in question is criminal proceeding No. 991/10098/26 concerning former beneficial owner of PrivatBank Ihor Kolomoiskyi and former top executives of the bank.

According to the investigation, the defendants are charged with misappropriation of property on an especially large scale by an organized group, legalization of property obtained through criminal means, and official forgery. Their actions are classified under Part 5 of Article 191, Part 3 of Article 27, Part 3 of Article 28, Part 1 of Article 366, and Part 3 of Article 209 of the Criminal Code of Ukraine.

In addition to Kolomoiskyi, the defendants include former Chairman of the Board of PrivatBank Oleksandr Dubilet, his deputy Liudmyla Shmalchenko, Head of the Interbank Operations Department Nadiya Konopkina, Head of the Interbank Dealing Department Yaroslav Luhovyi, and Deputy Head of the Correspondent Bank Accounts Department Tetyana Yakymenko.

According to the investigation, the scheme to misappropriate funds was organized in 2015, when Kolomoiskyi was the owner of PrivatBank.

At that time, the bank was allegedly forced to pay over UAH 9.2 billion to a controlled company under the pretext of a buyback of its own bonds at an inflated price.

According to the investigation, another UAH 446 million was laundered through transactions with securities of affiliated companies.

Previous attempts have been made to have cases against Kolomoiskyi heard in a different court. In particular, former Chairman of the Board of PrivatBank Oleksandr Dubilet earlier sought to transfer another case concerning the embezzlement of the bank’s funds from the HACC to the Zhovtnevyi District Court of Dnipro (now the Sobornyi District Court of Dnipro).

At that time, the Supreme Court rejected those arguments, noting that the issue of jurisdiction had already been resolved in October 2023 and could not be reconsidered.
