The former head of the supervisory board of "Finrostbank" is suspected of embezzling depositors’ funds

The police are investigating the misappropriation of depositors’ funds in 2014 by the Chairman of the Supervisory Board of JSC "Finrostbank," Oleksandr Bondarev.

This became known from the materials of criminal proceedings No. 12018160480000532 under Part 1 of Article 191 of the Criminal Code.

The criminal proceedings were initiated in February 2018 based on a statement by the authorized representative of the Deposit Guarantee Fund for the liquidation of the bank, Oleh Andronov. According to the statement of the authorized representative of the Deposit Guarantee Fund, an analysis of the financial operations of "Finrostbank" revealed a number of violations in the actions of the management. The exact amount of damage has not yet been determined.

In particular, according to the documents, the bank suffered damages totaling approximately 33.19 million UAH during the lending to LLC "DK ’ZOK’."

In 2012, when concluding a loan agreement to secure the obligations, LLC "DK ’ZOK’" transferred to "Finrostbank" as a mortgage the property of LLC "Prymorskyi Boulevard XXI" in the form of non-residential premises in the basement, first, second, and third floors, attic, and mezzanine, with a total area of 2.39 thousand square meters at 5 Prymorskyi Boulevard in Odesa.

In April 2014, the aforementioned mortgage agreement was terminated. As a result, the Odesa property was removed from the mortgage six months before the bank was declared bankrupt and its liquidation began in October 2014. According to the inspection materials, there is no record of a decision by the credit committee of "Finrostbank" to terminate the aforementioned agreement.

It should be noted that as of 2014, LLC "DK ’ZOK’" owned a 95.09% share in the authorized capital of LLC "Prymorskyi Boulevard XXI," meaning it indirectly owned the property.

Currently, the owner and director of LLC "DK ’ZOK’" with a statutory fund of 42 thousand UAH is listed as Serhii Maslov, while the beneficiaries of LLC "Prymorskyi Boulevard XXI" with a capital of 2.74 million UAH are listed as Roza Azhyba and Vadym Vorona in equal shares.

Separately, it is worth mentioning the mortgaged property. At 5 Prymorskyi Boulevard, there is the revenue house of Lerche. In 2012, under strange circumstances and allegedly through the mediation of the head of the land committee of the city council, Dmytro Kot, it was transferred to the ownership of LLC "Prymorskyi Boulevard XXI."

Furthermore, in July 2014, "Finrostbank" prematurely returned a deposit of 7.24 million USD to one of the depositors, which was placed under a contract until December 2016. At the same time, this depositor in June 2014 acted as a guarantor for the loan of LLC "DK ’ZOK’" and pledged part of their deposit in the amount of 2.8 million USD to the bank.

At that time, the bank already had outstanding debts to its depositors amounting to 39.8 million UAH, 1.62 million USD, and 66.33 thousand EUR.

In addition, by issuing a large sum in foreign currency to a depositor through the cash desk, "Finrostbank" violated the legislation in force in 2014 regarding the restriction on cash withdrawals in foreign currency from current and deposit accounts of clients through cash desks and ATMs, limited to 15 thousand UAH per day per client at the official NBU exchange rate.

Overall, during the period of 2012-2014, the former management of "Finrostbank," through a series of credit operations with related and shell companies in gross violation of internal procedures, withdrew the bank’s assets amounting to approximately 1 billion UAH.
