Mobilization in Ukraine: who in the family cannot be drafted into the AFU

In Ukraine, during mobilization, several able-bodied men from the same family may be called up for service. This was reported by lawyer Illya Shypko.

Ukrainian legislation does not provide for a ban on the mobilization of able-bodied men from the same family; as a result, there is no legal ban on the simultaneous conscription of father and son.

“If the father and son/sons are fit for military service and have reached mobilization age, they can be mobilized even at the same time. However, it should be understood that there are exceptions for certain categories of persons and then such mobilization may not take place,” the lawyer said.

According to Shipko, in a family where there is, for example, a woman with a disability, father and son cannot be called up. According to the law of Ukraine “On mobilization and mobilization preparation,” someone alone must take care of her, and therefore has the right to a deferment. The legislation does not define who exactly has the right to a deferment, and therefore “father and son must personally decide among themselves who will be mobilized,” the lawyer noted.

Also, a man cannot be mobilized together with his father if he has three dependent children under 18 years of age. Because, according to Article 23 of the law of Ukraine, the father will have a deferment from conscription.

“Today, there is a legislative opportunity to simultaneously mobilize father and son. There are no laws that could abolish or prohibit such mobilization,” he added.
