Mobilization in Ukraine: who can get a reservation from April 1

In Ukraine, during war, all men 18-60 years old are subject to mobilization, but there are certain exceptions for them. In particular, “reserved” employees of critical companies and government bodies may not be accepted into military service.

OBOZ.UA tells who can apply for a deferment from mobilization from April 1 and for how long it is given. Note that today the possibility of some companies to buy reservations for their employees is also being considered.

Who is eligible for reservation during mobilization

In 2023, the Verkhovna Rada of Ukraine adopted a law on the procedure for reserving military personnel who are not subject to conscription during mobilization. According to it, the reservation may apply to the following categories of citizens:

– employees of state authorities and local self-government, if their work is necessary to ensure the functioning of these bodies during a special period;

– employees of critical enterprises, institutions and organizations (for example, those involved in the production of goods, performing work and providing defense services for the needs of the Armed Forces of Ukraine);

– employees of enterprises that are critically important for the economy and livelihoods of the population of Ukraine during the war.

Also, people’s deputies liable for military service during their term of office are not subject to mobilization, even without reservation. But deputies of local councils and employees in senior positions are subject to mobilization and reservation does not apply to them.

Which critical businesses will be able to book workers from April 1

New criteria for enterprises critical to the functioning of the economy and the livelihoods of Ukrainians during a special period, which can reserve their military-bound employees, the website of the Ministry for Strategic Industries of Ukraine reported. According to them, there are two booking options - from 50% and up to 50% of employees inclusive.

The category of 50% or more employees, regardless of military specialty, includes enterprises, institutions and organizations that:

– produce goods for the military;

– develop, modernize and repair military and special equipment and spare parts for it;

– produce ammunition and other defense products.

Also, each such enterprise must meet the following criteria:

– be in the process of executing a contract with a government customer in the field of defense or be a co-executor of such a contract;

– more than 50% of the total volume of their production must be goods, works and services for defense purposes (for the last reporting period).

The category of up to and including 50% of employees includes enterprises operating in:

– industry;

– aircraft manufacturing industry;

– the field of space activities.

Such an enterprise must meet three of the following five criteria:

– be in the process of executing a contract with a government customer in the field of defense or be a co-executor of such a contract;

– more than 50% of total production must be goods, works and services for defense purposes (for the last reporting period);

– to be included in the electronic register of selection participants and executors of government contracts (agreements) in accordance with the Law of Ukraine;

– participate in the implementation of tasks and measures provided for by state target programs in the aircraft manufacturing industry and in the field of space activities;

– produce goods, perform work and provide services for defense industry enterprises (using them for the manufacture of defense goods).

Whether the enterprise meets the necessary criteria or not is decided by the working group of the Ministry of Strategic Industry and other interested government bodies.

In addition, there is a discussion about lifting restrictions on other enterprises when paying a monthly payment for the reservation of workers - that is, so that it would be possible to buy a reservation from mobilization. In this case, the company will be able to book an employee regardless of his position. The company itself does not necessarily have to be included in the list of important sectors of the national economy or critical enterprises, but must pay taxes and not have any debts on their payment.

For what period are they booked from mobilization?

For employees of state authorities and local self-government, a deferment may be provided for the entire period of mobilization. But employees of enterprises are usually given a reservation for six months. However, in practice this period is often extended.

It is advisable for the employee to have at least a copy of the armor document with him at all times. This will help, for example, in interacting with the military in the event of serving subpoenas on the street.
