In the "Oberih" registry, it is planned to automatically include data on the health status of conscripts

Information about the results of medical examinations conducted to determine the suitability of conscripts, military personnel, and reservists effectively eliminates the guarantees of medical confidentiality.

Amendments are planned to be made to the Law "Fundamentals of Health Legislation of Ukraine" that will remove the guarantees of medical confidentiality regarding information on the results of medical examinations of conscripts, military personnel, and reservists, conducted to determine their fitness for military service. The relevant bill No. 12066 was registered in the Verkhovna Rada on September 24 by a group of deputies led by the head of the Parliamentary Committee on National Security Issues, Oleksandr Zavitnevych, and a member of this committee, Oleksandr Fediyenko. 

Currently, the law "Fundamentals of Health Legislation of Ukraine" in Article 24-3 stipulates that information interaction between the electronic healthcare system (EHS) and the Demographic Register, the State Register of Civil Status Acts, and the Register of Individuals – Taxpayers is carried out using the electronic interaction system of information resources or using the unified information system of the Ministry of Internal Affairs, complying with the requirements of the Law "On Personal Data Protection". It is important to note that during information interaction, access to a patient’s medical information is not allowed. This is clearly provided by law. Bill No. 12066 provides that the electronic healthcare system will also start automatically "sharing" data with the Unified State Register of Conscripts, Military Personnel, and Reservists "Oberih". 

At the same time, access to the patient’s medical information will be allowed for "obtaining information by the Ministry of Defence of Ukraine about the results of medical examinations of conscripts, military personnel, and reservists, conducted to determine their suitability to perform military duty for entry into the Unified State Register of Conscripts, Military Personnel, and Reservists to ensure national security and defence".
Furthermore, amendments are being made to the law on the Register of Conscripts, Military Personnel, and Reservists, which stipulates that the Ministry of Health must transmit to the "Oberih" register information about the results of medical examinations conducted to determine suitability for performing military duty.

The "Oberih" register obtains data through electronic information interaction with the electronic healthcare system using the electronic interaction system of state electronic information resources to obtain information about the results of medical examinations conducted to determine suitability.

What data is entered into the "Oberih" register? 

"Oberih" will contain personal data about all Ukrainian military personnel aged 18 to 60 years. The following data is entered into the register: 

  • Full name, date of birth, gender.
  • Passport details: internal and international passport details, individual tax number.
  • Place of residence.
  • Marital status: information about family members.
  • Education information: specialization.
  • Health status.
  • Place of work.
  • Criminal record information: criminal liability.
  • Information about trips abroad.
  • Phone numbers and email addresses.
  • Information on foreign language proficiency.
  • Information on the right to possess weapons.
  • Driver’s license details.

It is important to note that consent of individuals for the processing of personal data for the purposes of the register is not required. Currently, access to the "Oberig" register is granted to:  the Ministry of Defence of Ukraine, the General Staff of the Armed Forces of Ukraine, the Security Service of Ukraine, the Foreign Intelligence Service of Ukraine, and the Territorial Centers of Recruitment and Social Support.
