If within 3 working days after the postal office informs the man, he does not appear to receive the registered letter marked “TRC Summons,” the postal worker makes a note "the addressee is absent at the specified address" and returns such a letter to the TRC no later than the next working day.

The Cabinet of Ministers has amended the Rules for the Provision of Postal Services, equating the storage time of summonses from the TRC to court summonses. Thus, men have three days to receive a registered letter sent by the TRC. Otherwise, they face a TCC resolution with a fine ranging from 17,000 UAH to 25,500 UAH.

We remind you that, according to the Order of Conscription, proper notification of a reservist or a conscript about a call to the TRC in case of sending a summons by postal means is:

  • the day of receiving such a postal item by the person, confirmed by information and/or documents from the postal operator;
  • the day of placing a mark in the postal notification about refusal to receive the postal item or the day of placing a mark about the person’s absence at the residence address provided by the person to the TRC when updating their personal information;
  • the day of placing a mark in the postal notification about refusal to receive the postal item or the day of placing a mark about the person’s absence at the declared/registered residence address as per established legal procedure, if the person has not provided the TRC with an alternative residence address.

Therefore, the changes introduced by the government resolution dated October 8, 2024, No. 1147, stipulate that registered letters marked "TRC Summons" delivered to the specified address must be handed personally to the addressee (recipient). The Cabinet of Ministers clarified that registered letters marked "TRC Summons," "To be Delivered Personally" are subject to personal delivery to addressees.

However, if the addressee (recipient) is absent from the specified address, the postal worker informs the addressee (recipient) via the available phone number and/or places a notification in the subscriber’s mailbox about the arrival of a registered letter marked "TCC Summons."

If within 3 working days after the postal office has informed the addressee (recipient), they do not appear to receive the registered letter marked "TRC Summons," the postal worker makes a note "the addressee is absent at the specified address," which is certified by their signature with the stamp of the postal device, the usage procedure of which is established by the designated postal operator, and returns such a letter to the sender no later than the next working day.

Essentially, this will be "proper notification," after which the TRC may issue a fine resolution.

If the addressee (recipient) refuses to confirm with their signature the fact of refusal to receive a registered letter with the markings "Court Summons," "TRC Summons," the postal worker makes a note "The Addressee Refused" and returns it to the sender no later than the next working day.

In case of non-delivery of a registered letter with the markings "Court Summons," "TRC Summons," such items, along with the receipt notification form, are returned to the return address as per the procedure specified in these Rules, stating the reason for non-delivery.

We remind you, by the end of the year, the Cabinet of Ministers plans to send 900,000 summonses.
