The Court of Appeal has revoked the construction permits for the "Consul" club house in Odesa

The Fifth Administrative Court of Appeal on July 15, 2021, satisfied the complaint of the city’s GASK and canceled the urban planning conditions for the construction of the Consul club house on Fontanska Road, 64/1.

According to Monitor, the court also suspended the right to carry out construction work and canceled the registration of the declaration of readiness for the operation of the object. Recall that the court of first instance on April 27, 2021, sided with the developer and denied the city’s GASK in satisfying the claim. Now, it is expected that the developer will file a cassation appeal to the Supreme Court.

As the publication writes, the construction of the "Consul" club house turned out to be one of the most scandalous projects in Odesa. Construction work was initially carried out without land allocation, urban planning conditions were issued for the construction of summer houses rather than a residential complex. Moreover, the project was supposed to have five floors, but a seven-story building was actually constructed.

"But what is most surprising in this situation is the negligent attitude of the city authorities, who themselves leased the land for development to an unscrupulous developer, and six months later realized and started shouting about illegal construction. The city council allocated the land when construction work was already being carried out on the seized land," the publication notes.

The customer of the construction is LLC "UkrSmart". According to data from the YouControl portal, a certain Serhiy Berezovskyi is registered as the beneficiary.
