Mobilization in Ukraine: what cars of citizens are allowed to be confiscated for the needs of the AFU

On April 11, in the second reading, parliament voted for the mobilization bill. As a result, representatives of TRC and SS will be able to confiscate cars from some citizens for the needs of the Armed Forces of Ukraine. Lawyer Yaroslav Zvonenko spoke about this in more detail in a commentary to RBC-Ukraine.

According to him, cars for the Armed Forces of Ukraine can be confiscated from those citizens who have more than one vehicle. In addition, the vehicle will be assessed and the one that is more suitable for defense needs will be selected.

“For example, if you have a sedan and an SUV, then the SUV will be confiscated from you. If you have two SUVs, then the one with the lower market value will be confiscated,” Zvonenko explained.

How will cars be confiscated from Ukrainians?

The resolution of the Cabinet of Ministers “On approval of the Regulations on military transport duties” and the law of Ukraine “On mobilization preparation and mobilization” and the law “On the transfer, forced alienation or seizure of property under the legal regime of martial law or a state of emergency” determine the procedure for the seizure of transport.

According to Zvonenko, setting limits on the seizure of cars is the responsibility of the TCC and can occur by decision of the Cabinet of Ministers. But the vehicle can be returned to the owner within 30 days after the announcement of demobilization.

The lawyer noted that it is worth knowing the difference between “alienation” and “mobilization of transport.” In particular, during alienation, a citizen is deprived of ownership of transport; this occurs with full or partial compensation. Whereas during mobilization, the car is taken away temporarily and without deprivation of ownership.

“The vehicle can be mobilized by the TRC and SS, the SSU, as well as the relevant units of the Foreign Intelligence Service,” said Yaroslav Zvonenko.
