Mobilization in Ukraine: 2 million men may automatically become draft dodgers

On April 24, the Ministry of Defence of Ukraine announced that the new Law on Mobilization will come into force on May 18.

One of the norms affecting millions of Ukrainian men is the obligation to update their data within 60 days.

What punishment awaits those persons liable for military service who are registered and have not updated their data within 60 days in the TRC, TsNAP or in the electronic account of the person liable for military service (after the law comes into force), and those who are not registered and also not updated the information - lawyer Mykola Maksimov, who understands, in particular, issues of mobilization, spoke about this in a commentary for TSN.ua.

He tells the following about the expected algorithm of actions: “If a person has not updated personal data, then the TRC contacts the police, who will enter this person into the appropriate search database. The police will try to find this person.”

According to Maksimov, given the fact that there will be tens of thousands of such wanted people, the criminal investigation department will not deal with this, conducting, for example, billing phones.

“Most likely, district or patrol police will be involved in the search. They will come to where the person lives. If he is not there, the information is returned to the TRC. After this, the TRC sends a demand to the person liable for military service at an address known to him. We are talking about a requirement to appear If within 10 days from the date of receipt or non-receipt of this request the person does not appear, the TCC applies to the court with a statement of claim to restrict the right to drive a vehicle,” says Mykola Maksimov.

To this he adds: “In addition, the court may impose a fine in the range of up to 25 thousand UAH. If it is not paid, then the information is transferred to the executive service. The latter enters the person into the register of debtors, seizes the property of this person, and limits his use of bank cards."

If a person is not registered and has not updated his data, consequences may occur after such a person’s documents are checked on the street, at a checkpoint.

As the lawyer notes, the police will have the right to take the person to the TRC.

“If the TRC contacts the police in order to deliver a wanted person to the TRC, then administrative detention occurs. Coercive measures provided for by the Code of Administrative Offenses may be applied to the person. That is, such a person is taken to the TRC,” clarifies Mykola Maksimov.

Use bank and postal information

To the question about what registers and information the TRC will work with if a person is not registered with the military, the lawyer answers this way: “I can say that banks 100% leak information about male persons of the appropriate age, information can be provided by the state migration service.” service, the Ministry of Internal Affairs. There are rumors that there is communication with a large postal company. All authorities accumulate and transmit information to the TRC."

2 million men may be wanted

According to Mykola Maksimov, about 2 million men of the corresponding age could potentially be put on the wanted list.

“I am sure that this law is not aimed at the police searching for someone en masse. At most, the police will go to the place of residence, call on the phone, and ask,” says the lawyer.

He adds: “This is more aimed at immediately putting people on the wanted list without issuing a summons. Today, if a person does not appear on the summons, then, of course, there is a search. And they made it so that everyone would immediately be wanted. and everyone could be detained on the street. This is the main goal. Because now it is impossible to detain, there is no reason, the person is not wanted on the street."
