The illegal mobilization does not exempt Ukrainian citizens from service, - Supreme Court of Ukraine

The Supreme Court of Ukraine made this decision.

As noted on the court’s website, this resolution was issued by the Administrative Cassation Court as part of the Supreme Court in response to a claim filed by a serviceman against the district Central Military Enlistment Office, challenging the legality of his mobilization and requesting discharge from service.

The court concluded that the mobilization procedure is "irreversible, and recognizing the mobilization procedure as illegal does not lead to the restoration of the previous status of the person drafted into military service through their discharge."

Meanwhile, the first instance courts and the appellate court recognized the mobilization of this man as illegal and ordered the military unit to cease his service. However, the Supreme Court took a different position.
