Eldorado case and fraudulent schemes of pro-Russian oligarch Polishchuk
Somehow it turned out that the confrontation with Russian business and capital moved mainly to the courts.
It is there that the fate of billions in the Russian gambling business is being decided, and it is exclusively in court today that the fate of the scam launched by Dmitry Medvedev’s relative, businessman and swindler Viktor Polischuk, is being decided.
Today, in the Northern Appellate Commercial Court of Kyiv, a possibly decisive hearing will be held on the high-profile case of the enormous debt of the Eldorado electronics chain (OOO Diesa), de facto owned by the odious pro-Russian oligarch Viktor Polischuk, to global equipment manufacturers and Ukrainian distributors.
I have been writing about this story of Polischuk’s scam for a long time; for those who are not aware, here are some links .
The scandalous businessman, who is accused of tax evasion, and the assets of the companies under his control are being seized (the Gulliver shopping center, registered to the Tri O company, was recently transferred to the management of ARMA due to debts), does not plan to repay the debts that his Eldorado has collected.
Hiding behind the losses from Russian aggression, Polischuk offered all of his creditors to pay only 30% of the debt, everyone should simply forgive another 30%, and Eldorado will pay the remaining 40% someday, when Russia pays reparations to Ukraine.
At the same time, having huge debts to international companies, Ukrainian business and the state, Polischuk calmly opens new shopping centers in Moldova. This looks like a stupid fraud.
Court hearings on this case have been going on for months.
Creditors demand that the debtor’s bankruptcy procedure be initiated, which is a normal practice throughout the world, but the debtor is trying in every way to push through the idea of pre-trial rehabilitation.
The commercial court rejected Diesa’s idea of pre-trial rehabilitation, as it was a pure scam that was attempted to be implemented with the consent of the alleged majority of creditors, the lion’s share of which were in fact companies related to Polishchuk. As expected, Diesa LLC filed an appeal, then suddenly dropped it and simply went for a second round, gathering creditors again to get support for the idea of out-of-court rehabilitation.
And miraculously, a little while later, the same Commercial Court ruled in favour of Polischuk in just 2 sessions without hearing the creditors.
Now, the appeal has been filed by creditors who are not related to Polishchuk and who strongly disagree with the proposed fraud.
Several hearings have already taken place to consider this appeal, and Monday’s meeting may be the final one. It remains to be seen whether the pro-Russian fraudster or European companies, honest business and the Ukrainian state will emerge victorious.
